A woman who ran a stop sign in Carlsbad and fatally struck a mother riding an electric bicycle with her daughter was sentenced Thursday to 90 days in county jail and 90 days of home detention.
Lindsay Turmelle, 43, pleaded guilty to misdemeanor vehicular homicide in August. 7, 2022, crash that killed Christine Embree, 35 years old.
Embree was riding with her 16-month-old daughter when Turmelle’s Toyota 4-Runner struck her near the intersection of Basswood Avenue and Valley Street. Embree died a day later. Her daughter was not injured.
According to defense attorney Joni Eisenstein, Turmelle was driving home from work and looked down for a moment while driving, leading to the fatal accident.
“It’s a mistake Ms. Turmelle made that she can never take back and she waited until the day of the incident to apologize,” said Eisenstein, who described his client as “consumed with remorse and regret.”
In a statement made in court, Turmelle said he already has public speaking events planned at schools and other places where he intends to talk about his experience and warn others about the dangers of distracted driving.
She told Embree’s family: “I can’t imagine what it’s been like for you. I’m praying for your comfort. I’m praying for you to heal. I’m praying for your understanding and I’m praying for your forgiveness. I can’t compare what what I’m going through with what your family is going through every day.”
Deputy District Attorney Kaleb Fulbright sought the maximum possible sentence for vehicular homicide, which is one year in county jail.
The prosecutor claimed that after the crash, Turmelle told police she had come to a complete stop, something he called a “blatant lie” that was later disproved by the data of traffic obtained by his vehicle.
He also said Turmelle had a history of traffic accidents and violations, which included running a red light about three months before the fatal crash.
Fulbright said she should have made herself more aware of the dangers of driving while distracted.
“The defendant thought that whatever she was doing at the time, whatever was distracting her, was more important than simple road safety,” Fulbright said.
Superior Court Judge Alejandro Morales agreed that Turmelle’s driving record should have the notice.
However, he noted that she was “extremely remorseful”, tried to make amends by talking about her experience and said she believed “society is better served” by having her dissuade others with her story, rather than to send to prison for one. year.
The judge ordered Turmelle to appear in court in February, when she will be taken into custody to begin serving her prison sentence. Morales said he delayed the start of his custody because Turmelle has a speaking engagement scheduled this month.
Along with custody, she will be required to speak at 10 traffic school events and complete 50 hours of volunteer work.
The accident was one of two fatal bicycle collisions during August 2022 in Carlsbad. Those crashes, coupled with a spike in e-bike and bicycle collisions across the city, led Carlsbad officials to declare a local state of emergency.
